These Terms of Service ("Terms") govern your use of the TenderPartner website (tenderpartner.ca) and bid-writing services, operated by ENPLABS VENTURES ("TenderPartner", "we", "our", "us"). By submitting an eligibility application, ordering a proposal package, or otherwise using our services, you agree to these Terms.
1. What TenderPartner Does
TenderPartner is a proposal-writing and bid-support service for Canadian municipal government tenders. We monitor public procurement portals, match opportunities to your trade and region, and draft technical proposal documents, RFQ schedules, and compliance materials on your behalf.
We are not a law firm, bidding agent, or government-affiliated body, and we do not submit bids on your behalf. You always review the final document and submit it yourself, under your own company name, on the relevant government portal.
2. No Regional or Trade Exclusivity
TenderPartner does not offer or guarantee exclusive rights to any trade category, city, or region. We may work with multiple clients in the same trade or the same municipality at the same time, including clients who compete on the same tender. Any statement elsewhere suggesting limited availability refers to our own capacity to take on new proposal work at a given time, not a guarantee of exclusivity.
3. Pricing and Payment
Proposal and RFQ packages (RFQ Completion, Standard, Advantage, Complete) are billed as a flat, one-time fee per order, payable in advance via Stripe before drafting work begins. RFP Alerts is a separate, optional $9 CAD/month subscription you may cancel at any time; cancellation takes effect at the end of the current billing period.
Because drafting work begins promptly after payment, orders are non-refundable once work has started, except where required by law. If you believe there has been a billing error, contact us at [email protected] and we will review it in good faith.
4. No Guarantee of Contract Award
We draft proposals to be complete, compliant, and competitive based on the tender documents and the information you provide. We do not control, and cannot guarantee, the outcome of any procurement process. Contract awards are decided solely by the issuing municipality or authority based on their own evaluation criteria.
5. Your Responsibilities
You are responsible for:
- Providing accurate and complete information about your company, licensing, insurance, bonding, and operational capacity
- Confirming your business meets any mandatory eligibility requirements of a given tender before we begin drafting
- Reviewing the final proposal for accuracy before submission
- Submitting the proposal yourself, on time, through the correct government portal
TenderPartner is not responsible for a missed submission deadline, a disqualification, or an inaccuracy in information you supplied to us.
6. Ownership of Deliverables
Once payment is received in full, the proposal document we draft for you is yours to use, edit, and submit for the tender it was written for. TenderPartner retains no ownership claim over your submitted bid or the resulting contract.
7. Limitation of Liability
TenderPartner is not affiliated with, endorsed by, or acting on behalf of any municipality, procurement portal, or government authority. To the maximum extent permitted by law, TenderPartner's total liability for any claim arising from our services is limited to the amount you paid for the specific proposal package giving rise to the claim.
8. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
